Recently we lodged a s73 Applications to remove an unwanted easement on title with the Land Titles Office Victoria
The unwanted carriageway easement was in Richmond. The application was lodged on 11 March 2016. Once the Application is lodged the application goes through an examination phase. In this case after the initial application the case officer made a requisition for validation that the local council had no interest in the easement as a public road. Because this was the case the requisition was satisfied. The Application has now been approved and registered. The time from filing to registration in this case was approximately 3 months. The title and the title plan have been updated with the unwanted easement now removed.
